RETURN AND EXCHANGE RULES

1. General provisions

1.1. If it is necessary to return or replace the product (due to the presence of a factory defect or for other reasons), please contact us in advance at tel. 1.2. Refunds are made on the basis of the buyer's application, drawn up in accordance with the requirements established in clauses 2.1., 2.2 of Section I of these Rules, within 7 (seven) calendar days from the day the seller receives the buyer's application (unless otherwise specified in these Rules), provided return of goods by the buyer to the seller.

1.3. The warranty period for the product is 14 (fourteen) calendar days from the date of sale of the product (unless otherwise specified in the product warranty card), with the exception of consumables (oils, filters, technical fluids, etc.). The performance of consumables is checked by the buyer at the time of receiving the goods. The date of sale of the goods is established according to the original documents for the sale of the goods.

1.4. Funds are refunded to a payment card, as well as in cash, within 5 (five) days from the moment of receipt of the refund application provided for in clause 2.2. of these Rules. Refunds to the buyer are made upon presentation of documents certifying the identity of the buyer.

1.5. Refunds are made exclusively in the national currency of Ukraine - the hryvnia.

Section I. Return (replacement) of goods (buyer - business entity)

2. Return (replacement) of low-quality goods (factory defect)

2.1. The product is returned according to the return invoice. The amount of money paid for the goods is returned to the current account from which the payment was made, if there is a statement provided for in Clause 2.2 of Section I of these Rules. In the event of a change in the buyer's payment details for the transfer of funds, it is necessary to provide a letter on the business entity's letterhead indicating the new payment details.

2.2. To return the money, the buyer makes a statement on the form of the business entity in the name of the seller, indicating:

  • name (or surname, first name, patronymic) of the buyer, his identification code (registration number of the taxpayer's account card (if available)), address for correspondence;
  • product name according to the invoice;
  • the amount of money paid for the goods;
  • details of the current account from which payment for the goods was made;
  • reasons for returning the goods;
  • date of signing the application, the buyer's signature, seal (if available).

2.3. Transportation costs associated with the return (exchange) of goods of inadequate quality are borne by the seller.

2.4. The buyer has the right to report product defects within 14 (fourteen) calendar days from the moment of sale. The seller has the right not to consider the claims sent by the buyer after the expiration of the term specified in this clause.

2.5. If during the warranty period it is necessary to determine the reasons for the loss of product quality, the seller has the right to organize an examination of the product by his own forces (the seller's technical service) or by involved third-party expert organizations. If it is proven in the expert opinion that the defects arose after the goods were handed over to the buyer as a result of violating the rules of use, storage or transportation established by him or the actions of third parties, the buyer's claims will not be satisfied, and the buyer is obliged to reimburse the seller for the costs of the examination.

 

3. Return (replacement) of quality goods

3.1. In the event that the product did not suit you in terms of technical characteristics or for other reasons not related to product defects, the return (exchange) of the product in such a case is carried out with the prior consent of the seller.

3.2. Transport costs associated with the return (exchange) of goods of appropriate quality are borne by the buyer.

3.3. The return (exchange) of the product is possible only on the condition of preservation of the product appearance, consumer properties, seals, labels, factory packaging, absence of signs of use (for liquids - opening the package) and all original (factory) markings on the product.

Section II. Return (replacement) of goods (buyer - consumer)

 

4. Return (replacement) of low-quality goods (factory defect)

4.1. In the event that defects are detected during the established warranty period, the consumer has the right to demand:

  • proportional price reduction;
  • free elimination of product defects within a reasonable period of time;
  • reimbursement of expenses for the elimination of product defects.

4.2. In case of discovery during the established warranty period of significant defects that arose due to the fault of the manufacturer (seller) of the product, the consumer has the right to demand:

  • termination of the contract and return of the money paid for the goods;
  • demand replacement of the product with the same product or with a similar product from among the products available at the seller.

4.3. The consumer has the right to submit one of the requirements provided for in Clause 4.1 of Section II of these Rules, and in case of non-fulfillment, to state another requirement provided for in Clause 4.1 of Section II of these Rules.

4.4. If the product is available, the consumer's request for its replacement is subject to immediate satisfaction, and in the event of a need for quality control - within 14 (fourteen) days or as agreed between the seller and the buyer.

4.5. If the product is not available, the consumer's request for its replacement shall be satisfied within two months from the moment of submission of the relevant application. If it is not possible to satisfy the consumer's demand for product replacement within the specified period, the consumer has the right to present to the seller other requirements provided for by the legislation on the protection of consumer rights.

4.6. When the consumer presents a demand for free elimination of product defects, they must be eliminated within 14 (fourteen) days from the date of its presentation or by agreement of the parties in another period.

4.7. The consumer's requirements are considered after the consumer presents the settlement document with a mark on the date of sale.

4.8. The consumer's demands cannot be satisfied if the defects of the product arose as a result of the consumer's violation of the rules for using the product or its storage.

4.9. Transportation costs associated with the return (exchange) of goods of inadequate quality are borne by the seller.

4.10. The buyer has the right to report product defects within 14 (fourteen) calendar days from the moment of sale. The seller has the right not to consider the claims sent by the buyer after the expiration of the term specified in this clause.

4.11. If during the warranty period it is necessary to determine the reasons for the loss of product quality, the seller is obliged to organize an examination of the products within three days from the day of receiving written consent from the consumer. The examination is carried out at the expense of the seller. If the conclusions of the examination prove that the defects arose after the product was handed over to the consumer as a result of violating the rules of use, storage or transportation established by him, or the actions of third parties, the consumer's claims shall not be satisfied, and the consumer shall reimburse the seller for the costs of conducting the examination.

4.12. Other consumer rights related to the return (exchange) of low-quality goods are provided for by the Law of Ukraine "On the Protection of Consumer Rights".

5. Return (replacement) of quality goods

5.1. The consumer has the right to exchange a non-food product of appropriate quality for a similar one from the seller from whom it was purchased, if the product did not satisfy him in terms of shape, dimensions, style, color, size, or for other reasons it cannot be used for its intended purpose.

5.2. The consumer has the right to exchange goods of proper quality within 14 (fourteen) days, excluding the day of purchase.

5.3. The exchange of goods of appropriate quality is carried out if it has not been used and if its appearance, consumer properties, seals, labels, as well as the settlement document issued to the consumer together with the sold goods have been preserved.

5.4. If, at the time of the exchange, a similar product is not available for sale, the consumer has the right to either purchase any other product from the available assortment with a corresponding recalculation of the cost, or terminate the contract and receive back money in the amount of the value of the returned product, or exchange the product for a similar product at the first upon receipt of the corresponding product for sale. The seller is obliged to notify the consumer who requests the exchange of the product on the day the product is put on sale.

5.5. Upon termination of the sales contract, settlements with the consumer are made based on the value of the product at the time of its purchase. The money paid for the goods is returned to the consumer on the day of termination of the contract, and if it is impossible to return the money on the day of termination of the contract - at another time as agreed by the parties, but no later than within seven days.

5.6. Transport costs associated with the return (exchange) of goods of the appropriate quality, as well as the transfer of funds to the buyer, are carried out at the expense of the buyer.
